These Terms and Conditions ("Agreement") govern the rental of roll-off dumpsters from Northshore Dumpsters LLC to the customer ("Customer," "you," or "your"). By renting a roll-off dumpster from our company, you agree to abide by these terms and conditions.
1. Rental Agreement
By signing or accepting this Agreement, you agree to rent a roll-off dumpster from Northshore Dumpsters LLC for the specified rental period, at the agreed-upon price, and subject to these Terms and Conditions.
2. Rental Period
The standard rental periods are one, three, and seven days, beginning from the date of delivery. Additional rental days may incur extra charges. If you need to extend the rental period, you must notify Northshore Dumpsters LLC before the end of the rental period, and we will inform you of the applicable charges.
3. Delivery and Pickup
Delivery: Northshore Dumpsters LLC will deliver the dumpster to the location specified by you in the rental order.
Pickup: Upon completion of the rental period or as requested by you, Northshore Dumpsters LLC will pick up the dumpster.
You agree to ensure that the delivery and pickup locations are accessible and free of obstacles that may hinder the delivery or pickup process. A $50 fee will apply if the dumpster is inaccessible at the time of pickup.
4. Fees and Payment
Rental Fees: The rental fee for the dumpster is based on the type, size, and rental period of the dumpster.
Overage Fees: Fees for exceeding the weight limit will be applied if the weight exceeds 2 tons or 4,000 pounds. A fee of $65 will apply for every 2000 pounds over the set weight restrictions.
Payment Terms: Payment is due upon drop-off, unless otherwise arranged. We accept cash, credit card, check, or certified check. If a personal check is the method of payment and it does not clear a fee of $50 will be applied to the balance of the account and the pursuit of legal action if not paid within 30 days of pickup. If payment is not collected at the time of pickup, the contents of the dumpster will be left at the location of the rental.
Out of Area Fees: A fee of $100 will be applied for rental outside the coverage area that is cover on the website.
Additional Fees: You will be responsible for any additional charges, including but not limited to overweight charges, rental length overage charges, or disposal fees for restricted or hazardous materials.
5. Accepted Materials
The dumpster is to be used for general waste and construction debris only. The following materials are prohibited:
CUSTOMER ACKNOWLEDGES THAT LOCAL, MUNICIPAL, CITY, COUNTY, STATE AND/OR FEDERAL LAWS, REGULATIONS, RULES AND ORDINANCES PROHIBIT THE STORAGE OF CERTAIN ITEMS, MATERIALS AND SUBSTANCES IN THE EQUIPMENT, INCLUDING WITHOUT LIMITATION, TIRES, BATTERIES, TREE STUMPS, RAILROAD TIES, CHEMICALLY TREATED LUMBER, PAINTS AND LACQUERS, OILS, ASBESTOS, INFECTIOUS WASTE, CONTAMINATED SOILS AND ABSORBENTS, INKS AND RESINS, INDUSTRIAL DRUMS, WATER HEATERS AND WATER TANKS, FOOD WASTE, FUELS, ADHESIVES, REFRIGERANTS, AEROSOLS, AND OTHER RADIOACTIVE, VOLATILE, HIGHLY FLAMMABLE, EXPLOSIVE, TOXIC, SPECIAL OR HAZARDOUS MATERIALS AND SUBSTANCES. (“PROHIBITED MATERIALS”). THE CUSTOMER ACKNOWLEDGES AND AGREES THAT THE ONLY MATERIAL TO WHICH THE WASTE REMOVAL SERVICES ARE PROVIDED CONSIST SOLELY OF NON-HAZARDOUS GENERAL SOLID WASTE AND/OR CONSTRUCTION AND DEMOLITION DEBRIS OR OTHER INERT WASTE AND RECYCLABLE MATERIALS, AND DOES NOT INCLUDE ANY PROHIBITED MATERIALS, WHICH ARE SPECIFICALLY EXCLUDED FROM SUCH SERVICES. CUSTOMER AGREES TO NOT DEPOSIT OR PERMIT THE DEPOSIT FOR COLLECTION ANY PROHIBITED MATERIALS IN THE EQUIPMENT AND FURTHER THAT TITLE TO AND LIABILITY FOR PROHIBITED MATERIALS WILL REMAIN WITH CUSTOMER AT ALL TIMES. CUSTOMER IS SOLELY AND EXCLUSIVELY RESPONSIBLE FOR COMPLYING WITH ALL APPLICABLE LAWS RELATING TO PROHIBITED MATERIALS, AND CUSTOMER SHALL BE LIABLE FOR ANY CHARGES, COSTS, EXPENSES, DAMAGES, LEGAL FEES AND COSTS, LOSSES, FINES AND/OR PENALTIES (INCLUDING, BUT NOT LIMITED TO REGULATORY OR TRAFFIC FINES, PENALTIES OR ASSESSMENTS) OF WHATEVER NATURE RELATING TO THE DEPOSIT, STORAGE AND/OR TRANSPORTATION OR DISPOSAL OF PROHIBITED MATERIALS IN THE EQUIPMENT
If prohibited materials are found in the dumpster, you will be responsible for the removal and disposal costs, and Environmental fines and fees. If tires are found in. the dumpster a fee of $100 will be applied to the rental cost and the tires and or hazardous material will be returned to the Customers address.
6. Weight Limit
With each rental the Customer will receive 2 tons or 4,000 pounds of waste weight. If the Customer exceeds the agreed weight limit a fee of $65 per 2,000 pounds will be applied to the invoice.
7. Dumpster Use
The dumpster should only be used for the purpose of disposal of acceptable waste materials.
You agree not to overload the dumpster beyond its capacity, as this may create hazards or prevent the dumpster from being safely transported.
You are responsible for ensuring that the contents of the dumpster do not block or obstruct access to the dumpster during the rental period.
8. Damage to Dumpster
You, the Customer, agree to be responsible for any damage to the dumpster during the rental period caused by misuse, neglect, or improper loading. If the dumpster is damaged beyond normal wear and tear, you will be charged for repairs or replacement costs.
9. Liability and Indemnification
Northshore Dumpsters LLC is not responsible for any damage to property or injury caused by the use of the dumpster, including but not limited to driveway damage, landscaping damage, or personal injury.
You agree to indemnify and hold Northshore Dumpster LLC harmless from any claims, damages, or legal costs arising from the use of the dumpster, including any violation of laws or regulations.
10. Cancellations and Refunds
Cancellation Policy: Cancellations must be made at least 24 hours prior to the scheduled delivery for a full refund. Cancellations made within 24 hours of delivery may incur a cancellation fee.
Refunds: Refunds for unused rental periods are generally not provided. However, in the event of extenuating circumstances or delays on our part, a partial refund may be considered.
11. Termination
Northshore Dumpsters LLC reserves the right to terminate this Agreement at any time and remove the dumpster if you violate any of these Terms and Conditions, including but not limited to illegal dumping, prohibited materials, or non-payment.
12. Customer Responsibility
You, the Customer, are responsible for:
Ensuring that the dumpster is placed on your property and is legally permissible in that location.
Obtaining any necessary permits, licenses, or approvals required for placing the dumpster on public or private property (if applicable).
Notifying Northshore Dumpsters LLC of any changes in delivery or pickup instructions, including, but not limited to access issues or location changes.
13. Force Majeure
Northshore Dumpsters LLC is not liable for any delay or failure in performance under this Agreement caused by events beyond our control, including but not limited to natural disasters, government actions, strikes, or transportation delays.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Louisiana, without regard to its conflicts of laws principles.
15. Severability
If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Changes to Terms
Northshore Dumpsters LLC reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website or providing notice to you. By continuing to use our services, you agree to the updated Terms and Conditions.
